Limited Warranty for LeapFrog Baby Care Products

What does LeapFrog Baby Care limited warranty cover?

The manufacturer of this LeapFrog baby care product, LeapFrog Baby Care, warrants to the holder of a valid proof of purchase ("Consumer" or "you") that the baby care product and all accessories provided by LeapFrog Baby Care in sales package ("Product") are free from material defects in material and workmanship, pursuant to the following terms and conditions, when installed and used normally and in accordance with operation instructions. This limited warranty extends only to the Consumer for Baby Care Products purchased and used in the United States of America and Canada. 
 

What will LeapFrog Baby Care do if the Product is not free from material defects in materials and workmanship during the limited warranty period ("Materially Defective Product")?

During the limited warranty period, LeapFrog Baby Care's authorized service representative will repair or replace at LeapFrog Baby Care's option, without charge, a Materially Defective Product. If we repair this baby care product, we may use new or refurbished replacement parts. If we choose to replace this baby care product, we may replace it with a new or refurbished product of the same or similar design. LeapFrog Baby Care will return repaired or replacement products to you in working condition. LeapFrog Baby Care will retain defective parts, modules, or equipment. Repair or replacement of Baby Care Product, at LeapFrog Baby Care's option, is your exclusive remedy. You should expect the repair or replacement to take approximately 30 days.

How long is the limited warranty period?

The limited warranty period for the baby care product extends for ONE (1) YEAR from date of purchase (90 days on products purchased as Refurbished*). This limited warranty also applies to repaired or replacement Baby Care Products for a period of either (a) 90 days from the date the repaired or replacement Baby Care Product is shipped to you or (b) the time remaining on the original one-year limited warranty (90-day limited warranty on baby care products that are purchased as Refurbished*). Whichever is longer.

*Refurbished products purchased from our online store carry a 90-day replacement warranty.
 

What is not covered by this limited warranty?

This limited warranty does not cover:

  1. Baby Care Product that has been subjected to misuse, accident, shipping or other physical damage, improper installation, abnormal operation or handling, neglect, inundation, fire, water or other liquid intrusion; or

  2. Baby Care Product that has been damaged due to repair, alteration or modification by anyone other than an authorized service representative of LeapFrog Baby Care; or

  3. Baby Care Product to the extent that the problem experienced is caused by signal conditions, network reliability or cable or antenna systems; or

  4. Baby Care Product to the extent that the problem is caused by use with non-LeapFrog Baby Care electrical accessories; or

  5. Baby Care Product whose warranty/quality stickers, product serial numbers plates or electronic serial numbers have been removed, altered or rendered illegible; or

  6. Baby Care Product purchased, used, serviced, or shipped for repair from outside the United States and Canada, or used for commercial or institutional purposes (including but not limited to Baby Care Products used for rental purposes); or

  7. Baby Care Product returned without valid proof of purchase (see 2 below); or

  8. Charges for installation or set up, adjustment of customer controls, and installation or repair of systems outside the unit.
     

How do you get warranty service?

  • To obtain warranty service in the United States of America and Canada. Call 1-800-701-5327 for instructions regarding where to return the Baby Care Product. Before calling for service, please check the user's manual. A check of the Baby Care Product controls and features may save you a service call.
  • Except as provided by applicable law, you assume the risk of loss or damage during transit and transportation and are responsible for delivery or handling charges incurred in the transport of Baby Care Product(s) to the service location. LeapFrog Baby Care will return repaired or replaced product under this limited warranty to you, transportation, delivery or handling charges prepaid. LeapFrog Baby Care assumes no risk for damage or loss of the Baby Care Product in transit.

  • If the Baby Care Product failure is not covered by this limited warranty, or proof of purchase does not meet the terms of this limited warranty, LeapFrog Baby Care will notify you and will request that you authorize the cost of repair and return shipping costs for the repair of Baby Care Products that not covered by this limited warranty.

What must you return with the Product to get warranty service?

  1. Return the entire original package and contents including the Baby Care Product to the LeapFrog Baby Care service location along with a description of the malfunction or difficulty;
  2. Include "valid proof of purchase" (sales receipt) identifying the Baby Care Product purchased (Product model) and the date of purchase or receipt; and
  3. Provide your name, compete and correct mailing address, and telephone number.

Other limitations

This warranty is the complete and exclusive agreement between you and LeapFrog Baby Care. It supersedes all other written or oral communications related to this product. LeapFrog Baby Care provides no other warranties for this Baby Care Product. The warranty exclusively describes all of LeapFrog Baby Care's responsibilities regarding the product.
There are no other expressed warranties. No one is authorized to make modifications to this warranty and you should not rely on any such modification.

State Law Rights: This warranty gives you specific legal rights, and you also have other rights which vary from state to state.

Limitations: Implied warranties, including those of fitness for a particular purpose and merchantantability (an unwritten warranty that the product is fit for ordinary use) are limited to one year from date of purchase. Some states do not allow limitations on how long an implied warranty lasts, so the above limitation may not apply to you.

In no event shall LeapFrog Baby Care be liable for any indirect, special, incidental, consequential, or similar damages (including, but not limited to lost profits or revenue, inability to use the product, or other associated equipment, the cost of substitute equipment, and claims by third parties) resulting from the use of this product. Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you.

 

LIMITED HARDWARE WARRANTY AND LIABILITY

This limited warranty extends only to the Consumer for Products purchased and used in the United States of America and Canada.

LeapFrog Enterprises, Inc. (“LeapFrog”) warrants to the original consumer purchaser that the hardware shall be free from material defects in material and workmanship for a period of (i) three (3) months from the original purchase date for hardware other than LeapPad tablets and RockIt Twist devices; and (ii) one (1) year from the original date of purchase for LeapPad tablets and RockIt Twist devices (each period is a "Warranty Period"). LeapPad Ultimate, LeapFrog Epic, and LeapFrog Epic Academy tablets purchased on or after May 17, 2017 are excluded from coverage under this warranty but are covered under a separate warranty available here.

All warranty claims are subject to LeapFrog’s: (i) receipt of notice of a defect within the warranty period; (ii) verification of the existence of the defect in the product; and (iii) receipt of valid proof of the purchase date.

If the product is determined to be materially defective during the Warranty Period, your sole remedy and LeapFrog’s sole and exclusive liability under this warranty shall be limited to the repair or replacement of the product with a new or refurbished product at LeapFrog’s option. For purpose of this Limited Hardware Warranty and Liability, "refurbished" means a product that has been returned to its original specifications.

In the event that LeapFrog repairs or replaces your product under warranty, the repair or replacement will remain covered by this warranty for the remainder of the Warranty Period or, where the Warranty Period has expired, for thirty (30) days from the date that the product is returned to you.

This warranty is void and will not apply if the product is:.

  • Used with other products that are not compatible with the product;
  • Modified or tampered with;
  • Used for commercial purposes (including rentals);
  • Damaged by accident, unreasonable use, neglect, abuse, misuse or other reasons unrelated to defective materials or workmanship;, including but not limited to cracked or broken screens;
  • Immersed in water;
  • Damaged by improper installation and/or battery leakage;
  • Damaged by improper service and/or attempted service;
  • Damaged such that the serial number is altered, defaced or removed;
  • Used in a manner for which it is not designed;
  • Used with products not sold or licensed by LeapFrog, including, but not limited to, adaptors and power supply devices;
  • Purchased from an unauthorized dealer or distributor; or
  • Purchased secondhand or from an unauthorized reseller.

Email support@leapfrog.com to contact the LeapFrog Consumer Service Department about warranty issues. Before returning a product to LeapFrog, notify the LeapFrog Consumer Service Department. If the service representative is unable to solve the problem, you will be provided with instructions as to how to have the product repaired or replaced. If LeapFrog believes that there may be a valid warranty claim and confirms the original date of purchase for the product, LeapFrog will provide you instructions for returning the product.

You understand and acknowledge that in the event you return your product for repair, it may become necessary for LeapFrog to provide certain services to your hardware to ensure it is functioning properly. Such services may include the installation of the latest software or firmware updates. You acknowledge and agree that some services could change your current settings, cause a removal of cosmetic stickers, product skins or accessories, cause a loss of data or content or cause some loss of functionality. You should also remove any skins or accessories from your hardware before you send the hardware in for service. LeapFrog is not liable for damages resulting from your failure to comply with the foregoing or any instructions provided to you by LeapFrog. LeapFrog reserves the right to refuse service or void the warranty of any hardware that has been modified or tampered with.

THE LAWS OF CERTAIN JURISDICTIONS, INCLUDING QUEBEC AND SASKATCHEWAN, DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LEGAL OR IMPLIED WARRANTIES. THE LAWS OF CERTAIN JURISDICTIONS, INCLUDING QUEBEC, DO NOT ALLOW THE LIMITATION OF CERTAIN REMEDIES AND/OR DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE BELOW EXCLUSIONS OR LIMITATIONS MAY NOT APPLY TO YOU.

YOUR SOLE AND EXCLUSIVE RECOURSE IN THE EVENT OF ANY DISSATISFACTION WITH OR DAMAGE ARISING FROM THE USE OF THE HARDWARE OR REPAIR OF THE HARDWARE AND LEAPFROG’S MAXIMUM LIABILITY SHALL BE LIMITED TO REPAIR OR REPLACEMENT OF THE HARDWARE. IN NO EVENT WILL LEAPFROG BE LIABILE FOR ANY LOSS OF DATA, LOSS OF PROFIT OR ANY OTHER LOSS OR DAMAGE SUFFERED BY YOU OR ANY THIRD PARTY, WHETHER SUCH DAMAGES ARE DIRECT, INDIRECT, CONSEQUENTIAL, SPECIAL OR INCIDENTAL AND ARISING UNDER ANY THEORY OF LAW FOR YOUR USE OF THE HARDWARE.

This warranty gives you specific legal rights, and you may also have other rights which vary from state to state or province to province. This warranty is valid only in the United States and Canada. The warranty offered by LeapFrog is the same whether or not you register your product.

You will also have a three (3) month warranty from the date of delivery for media on which software is delivered (e.g. cartridge or cd rom). However, this warranty does not apply to software, including, but not limited to, software that is pre-installed in the hardware, or is subsequently provided via updates or upgrade releases. Such software is licensed to you under the terms and conditions of a separate software license agreement.
