Thank you for using a website, web-connected software application, or other online service (collectively, “Online Service(s)”) operated by LeapFrog Enterprises, Inc. On this page, we may simply refer to ourselves as “LeapFrog,” “we,” “our” or “us.”
Before reading further, please note that the statements below are reflective of activities across various LeapFrog Online Services, and are not necessarily reflective of activities on any single LeapFrog Online Service.
1- Why do we have this Policy and how can you contact us?
The people who bring LeapFrog products to life are passionate about education and dedicated to enriching the lives of children and adults through learning. Because we believe that learning and personal development are best achieved in an atmosphere of fun and safety, your confidence in our products and online practices is essential to our aspirations and success.
Please take a moment to read through this Policy to ensure you are aware of our practices and what additional steps you can take to protect your privacy. Because our online data collection activities are primarily targeted at parents and educators, the practices and terms set forth in this Policy are mostly relevant and addressed to "you" as a parent or educator. Therefore, all references to "you" or "your" refer to adult users, unless specifically noted otherwise. We have also developed a separate specific set of practices for the handling of any personal information we collect online about children or students. These are outlined in Section 10 below.
You are legally entitled to know what personal information about you and your children we hold, and how that information is processed. If you would like to know what information we hold about you, or if you have any questions or concerns about this Policy, please contact us in writing at:

Before you read this Policy, it is important to understand whether it applies to you or the specific LeapFrog Online Service you are using. In general, this Policy applies to consumer information, including personal information, gathered through any LeapFrog Online Service (as defined below). Below is a more detailed description of when this Policy applies, and when it does not.
- The Online Service being used is owned and operated by LeapFrog and posts a direct link to this Policy. This may include: (i) our main consumer website – LeapFrog.com, (ii) micro or product-specific sites such as Leapsterworld.com, (iii) our web-connected software applications (such as the LeapFrog Connect Application), (iv) sites and web-connected software applications designed for educators or other LeapFrog School consumers, such as LeapFrogSchool.com, Link to Lessons, and the LeapFrog School Connect Application; and, (iv) all international LeapFrog websites or web-connected software applications posting a direct link to this Policy or a translated version of this Policy. For simplicity and unless noted otherwise, we may collectively refer to all of the above-mentioned sites and web-connected services as “LeapFrog Online Service(s),” “our Online Service(s),” or “Online Service(s)”.
- The information collected is regarding LeapFrog consumers (i.e., individuals who buy or use our products and Online Services, including parents/guardians, teachers, educators, children, or students) and is captured by LeapFrog via the Internet (i.e., through a LeapFrog Online Service). Please see the next paragraph for whether and to what extent this Policy applies to data collected offline.
This Policy does not apply to any of the following:
- Information collected by LeapFrog through offline means (such as through a mail-in product registration card or on the phone by LeapFrog Customer Support), unless we clearly note otherwise at the place or time of data collection or the offline-collected data is merged and used together with online-collected data;
- Websites operated by other companies that we link to from our Online Services, or that provide links from their sites to ours. We are not responsible, and disclaim any and all responsibility, for the practices or content of such third party websites; or,
- Information given to us in a business capacity or for employment or work related purposes, such as information about our business customers (retailers, distributors, etc.), personal information provided by artists or other professionals we hire to help create our products, or job applicant data submitted through the Careers section of a LeapFrog website.
3- What are you agreeing to when you use our Online Services?
4- Changes to this Policy
From time to time, we may update this Policy. If we do, we will note at the top of this page the date that any changes are made and/or when they become effective. If the changes being made are material (for example, we want to use your information, specifically personal information, in ways we did not previously tell you about in this Policy or could not be reasonably expected by you), we will alert you to the changes in a more prominent way. For example, we may temporarily highlight the new or revised sections in this Policy, temporarily post a prominent notice on our home page or registration/login page, or temporarily add the word “Updated” to the title of this Policy and any hypertext links pointing to this Policy. In all instances where your consent is necessary, we will also send you an e-mail message or other communication telling you about the changes and asking for your consent to the additional use of your information. If you do not agree to the change in use, we will not use your personal information in this additional manner.
5- What information do we collect?
The information we collect through our Online Services will generally fall into one of the following categories (please carefully read and understand the definitions of the terms below, as these terms may be used repeatedly throughout the rest of this Policy):
Information you voluntarily provide us
- Personal Information (PI) such as your name, mailing address, e-mail address, phone number, credit card information (including billing and shipping information), or other information that allows us to directly or indirectly personally identify or contact you online or off. For users of LeapFrogSchool.com or other LeapFrog school websites or web-connected software applications, some of the personal or contact information described above may be requested about your school or children in your classroom (e.g., school name, school address, student name, school-assigned Student ID, etc.), instead of or in addition to you personally. No personal information is ever solicited or collected directly from children or children-aged students (for more information about our practices regarding children/students, please see Section 10 below).
- Demographic Information, which may include the following types of information about you and/or your children/students: age or date of birth, grades taught or grade level, highest level of education or graduation date, gender, products owned or of interest, favorite subjects and characters, languages spoken, involvement in school programs, and other non-personal or survey-type information including hobbies, attitudes, interests, and skills. Again, this type of information is only collected directly from adults (parents or educators) and, as mentioned above, pertains to themselves and/or their children or students. In some instances (such as for Learning Path registration on LeapFrog.com, registrations within web-connected software applications, and certain detailed surveys), demographic information may be combined and stored together with your personal information.
- Login Information such as username and password, secret answers to certain security questions, or other similar information that allows us to uniquely identify your account or authenticate you prior to giving you access to your account information or certain online activities. For some online accounts (such as a LeapFrog account created on LeapFrog.com), certain login information such as your username may, itself, be personal (like an e-mail address) or tied to other personal information.
Information passively or automatically collected
- Technical Information, which may include certain information or characteristics about your computer system, your LeapFrog product device, or LeapFrog web-connected software application. Specific examples include the type of computer operating system and web browser you use, your computer’s Internet Protocol (IP) Address, the names and versions of programs installed on your computer, and, for LeapFrog product devices, information about the device itself, including product ID or serial number, applications or software titles stored on the device, and product license information (i.e., information about the person or system licensed/authorized to use the product and/or its supporting software applications). For the most part, technical information such as the types described above remains anonymous (i.e., does not identify you personally), but in some cases can be traced back to personal information such as an e-mail address.
- Usage Information, which may collectively include non-personal information about: (i) how you or your children/students use, browse, or view content on our websites (“website usage” or “browsing” data), what products you buy or download online (“order history”), (ii) how you or your children/students use and interact with the basic functionalities of LeapFrog connected products or web-connected software applications (“product usage data”), and (iii) how your children/students perform and progress on certain tasks or activities when playing with LeapFrog connected devices or on certain child-friendly areas of LeapFrog’s websites or web-connected software applications (“play data”). Depending on the specific LeapFrog device, website, or web-connected software application being used and the specific type of usage information being collected, certain usage information may be linked or tied to other information in your account, including personal information.
We will use your information collected in accordance with the provisions of clause 6 of this Policy.
6 - How much information do we collect and when do we collect it?
The specific types and amounts of information we collect from adults from the categories above will vary depending on your level of interaction with our Online Services, but, as a general rule, will be relevant and proportionate to the service being requested or used. We may however automatically capture certain technical information and browsing data about your visit to a LeapFrog website or Online Service (such as the browser type you used, which web pages you visited, and how much time you spent on pages visited). (For more on passive or automatic data collection, please see Section 5 on cookies and other web technologies.) If you voluntarily choose to engage in a more active way with a LeapFrog Online Service such as by doing anything from the list below, we may request or require that you provide us certain personal and/or demographic information.
- Register or create an online LeapFrog parent account or LeapFrog School account (both of which may be referred to in this Policy as a “LeapFrog account” or “your account”)
- Purchase or download products, software, or other services
- Register products (for example, for warranty purposes or to receive recall notices)
- Sign-up for newsletters, product announcements, marketing or other communications
- Participate in promotions (contests, sweepstakes, store discounts, coupons, etc.)
- Use community features such as our Parent Community blogs and discussion forums, Learning Moments, Link to Lessons, or other similar online forums or social areas
- Contact or communicate with LeapFrog Customer Support
- Participate in online surveys, studies, polls or other market research (such as parent panels)
- Sign-up and participate in focus groups or product testing such as through LeapFrog Labs
- Submit testimonials, success stories, or product ideas
- Create and send e-cards, lesson plans, gift certificates or other content or messages using one of our send-to-friend or refer-a-friend features (Note: As part of these features, we may ask you for certain personal information about family members or friends, such as name, e-mail address, and/or shipping address, which we use to facilitate delivery of the requested item)
Please note that depending on the specific LeapFrog Online Service you are using, some, many, or all of the activities listed above may not be available. It is therefore possible that very little (if any) personal or demographic information may ever get collected from you. When these features are available and if you choose to use them, some of the activities may require that you first register or create a general LeapFrog account on the specific Online Service you are visiting/using. To do this, you may be asked to establish unique login information, in addition to providing personal and/or demographic information.
Consequences for not providing certain information
If you choose not to provide personal or demographic information when requested, your experience using our Online Services may be significantly limited. For example, without submitting personal information, you will not be able to buy products on our Websites or register to stay updated on LeapFrog’s newest products or special offers. Furthermore, if you choose not to allow us to upload certain usage information such as your child/student’s play data (when such options are available), we may not be able to provide you and your children/students a highly rich and personalized experience when using our products and Online Services.
More about product usage and play data
When you and/or your children/students use a LeapFrog product device which has a “Connected” component (e.g., the device connects to the computer for synchronization with a LeapFrog software application such as LeapFrog Connect), the physical device may keep a log of certain actions performed while the device is used. For example, the device may record such things as: (i) when the device is turned on/off, when the battery is low, when the device was last connected to the corresponding software application, and other similar product usage data; (ii) how many questions were answered by the child/student, the percentage of questions answered correctly, the number of times and amount of time the device was played with, and other similar play data; and, (iii) other similar events and performance patterns, as well as general statistics about these events (such as, the total number of times certain actions were performed). The next time you connect the device to your computer, this information may be uploaded from the device to the corresponding LeapFrog software application on your computer, and, if/when you are connected to the Internet, transmitted back to LeapFrog. The same kinds of information may be gathered and uploaded to LeapFrog when your child/student uses certain child-friendly areas of our Online Services.
The gathering of this information is primarily done so we can: (i) continue to enhance and customize the playing experience for users of our connected products; (ii) provide you with a personalized LeapFrog Learning Path that shows you the learning progress for each child/student player set up under your account (this may also be called a “footprint”); and (iii) recommend additional LeapFrog products to you based on such learning progress. In the school context, educators may be given the ability to download, save/archive, print, or email student progress information but only for school-related purposes.
Important play data controls
It is our desire that only you, the parent or educator who initially created the relevant LeapFrog account, have access to the LeapFrog Learning Path(s) associated with the child/student profile(s) under your account. We therefore recommend that in addition to the measures we take to protect your account information, you follow the tips provided under Section 8 below. This will help ensure that the child/student data under your account cannot be viewed or accessed by others. In addition, within the advanced settings area for each child/student profile under your account, you may be given the option to control whether play data (which is the data that forms the LeapFrog Learning Path) is continuously uploaded back to LeapFrog and/or to delete a certain amount of historical play data that had been previously uploaded to and stored on our servers. Although we do not recommend you exercise these controls (since it would essentially disable a primary reason for buying and using our connected devices), if you nonetheless choose to do so, please take special note of the following:
- If you delete past play data, this action will make the past play data anonymous and untraceable back to your unique LeapFrog account or an individual child/student. This will not, however, remove the information entirely;
- You may need to separately access and update each child/student profile under your account in order for play data controls to take effect on every child/student profile; and,
- The play data controls mentioned above will only impact the transfer of play data (whether current or past) from the software application on your computer to LeapFrog. Copies of children/students’ play data may remain locally on your computer and may continue to be collected and uploaded from the device to your computer, even if you have exercised the controls above.
Special note about community features
From time to time, we may provide online community or social-type features that allow you to publicly post, or share with other users, messages, stories, pictures, artwork, videos, testimonials, lesson plans, or other content. Along with such content, you may also be given the opportunity to post certain personal information about you or others to whom the content relates (for example, your name or part of your name, city and state of residence, and, for educators, title and name of your school). Although we may take certain precautions to protect those who use and participate in these activities (for example, by posting screen names instead of real names, obtaining your consent prior to publishing your content or personal information, filtering or cleansing content before it is posted, using pre-established messages, or limiting the group of people with whom users can interact and exchange information), we cannot guarantee the privacy of these areas and are not responsible for any information you choose to post or share. We encourage you to use common sense when using these services and never to reveal personal information about you or your children/students that you do not want others to see. Any information you post or share in these areas is done so at your own risk. If we choose to make any community features available to children users, we will be sure to obtain verifiable parental consent prior to granting children access to these areas. For more on our practices regarding children and children-aged students, please see Section 10 below.
7 - Cookies and other web technologies
LeapFrog may use a variety of standard technologies to: (i) enhance and personalize your experience while using our Online Services (including saving you the time of having to repeatedly re-enter information); (ii) generate statistics and information about traffic to and usage of our Online Services; and (iii) advise you of LeapFrog products, services, and/or special offers which may be of interest to you; and, (iv) run and measure the effectiveness of certain advertising or promotional campaigns, including those run by network advertisers on our behalf. These tools may include the following:
- Cookies – these are small text files that we may store on your computer to remember certain things about your visit to or use of our Online Services. For example, cookies might be used for any of the following: (i) remembering the content you previously viewed on a LeapFrog website, your online order history, items you placed in a wish list or shopping cart, or the nickname or device profile name you created when registering on one of our websites or web-connected software applications; (ii) keeping track of your children/students’ favorite games and activities (for example, within the LeapFrog Connect Applications), and any points or rewards they generate when playing them; (iii) for security purposes, such as to lock out underage users from certain activities or services; (iv) remembering or storing certain personal information (such as the username/email address you use to login to your LeapFrog account) so we can save you the time of having to re-enter this information, or re-market to you products in which you have previously shown interest; and/or (v) linking information contained in a cookie to personal information collected from you by other means (such as through account registration).
Most common web browsers today allow you to modify your settings to block cookies entirely, alert you every time they are being sent, or allow their use by only those websites you approve. You can also delete cookies that are currently stored on your computer’s hard drive. To do this, look for the Cookie control settings in your web browser (usually under Tools, Options/Internet Options, Privacy/Security tab) and then make your desired selections. If you choose to disable cookies, certain features of our Online Services may not be available or work properly and you may inadvertently delete the cookie that enables you to opt-out of ads served by network advertisers on our behalf (see below for more information).
- Log Files – these are files that record web activity and gather non-personal statistics about your visit to or use of a LeapFrog Online Service. Log files may help us capture, among other things: (i) your IP Address, which is a unique set of numbers assigned to your computer by your Internet Service Provider (ISP) (note that, depending on your ISP, the number assigned to your computer can be different every time you connect to the Internet); (ii) the type of browser and operating system you use; and, (iii) other information about your online session, such as the URL you came from to get to our website and the date and time you visited our website or used our Online Service. In addition to using this information to better understand how our Online Services are used, we may use information captured through log files such as an IP Address (together with your personal information) to troubleshoot technical problems, maintain online safety and security, and if necessary, prohibit or restrict access to our Online Services by certain users.
- Web beacons – Web beacons are small electronic image files that can be embedded within a web page or included in an e-mail message, and are usually invisible to the human eye. When used, web beacons (also known as “web bugs,” “clear GIFs,” or “tracking pixels”) may tell us such things as: how many people are coming to our websites or using our Online Services; whether they are one-time or repeat visitors; which pages they’ve viewed and for how long; how well certain online advertising campaigns are converting; and other similar website usage data. When used in an e-mail, web beacons can tell us the time the e-mail was opened, if and how many times it was forwarded, and what links users click on from within the e-mail message. Based on this information, we can adjust the content, products, services, and promotions we provide you to better meet your interests, as well as make you aware of LeapFrog products, services, and/or special offers in which you may be interested, given your past interaction with LeapFrog’s Online Services.
From time to time, we may hire an independent network advertising company so we can show you LeapFrog banner ads when you visit other, third party websites. To do this more efficiently, the network advertiser may use and place on your computer certain web technologies, such as cookies and/or web beacons, to collect from you non-personal information (in most cases, certain technical and/or browsing data as defined in Section 3 above) while you visit our websites or other websites participating in the same network. This information is then used to display advertisements about goods and services (whether offered by LeapFrog or other companies) more likely to be of interest to you when you visit those other websites. If you would like to learn more about this practice or how you can opt out from allowing network advertisers to gather this information from you or use it to provide you tailored ads on other sites, please visit the Network Advertising Initiative (NAI)’s website at: http://networkadvertising.org/consumer/opt_out.asp.
Please note that even if you use the mechanism above to opt-out from this type of information gathering, if, at any time, you disable or delete all cookies stored on your computer, you will have also disabled the same technology (namely, cookies) used by the NAI to help prevent you from receiving this type of advertising. If you do not want this to happen, please make sure not to disable/delete the NAI cookie, or add NAI to the approved list of sites from whom you allow or accept cookies (see Cookies paragraph above for instructions on how to change your browser’s cookie settings).
8 - How do we use your information within LeapFrog?
Primarily, LeapFrog uses your information to provide the Online Services that you request (see Section 4) and in the manner in which we have designed them. In other words, and by way of example only, if you register online for a LeapFrog account, the information you provide will be used to give you the benefits that come with having a registered account. This could include getting access to exclusive content and community features, as well as, if you indicate your consent to receive them, receiving newsletters and online store discounts from LeapFrog. If you contact Customer Support, your information will be used to respond to your inquiry or help address your concern, and to maintain a log of your customer support history to allow for faster processing of future inquiries. If you participate in a sweepstake, prize promotion or giveaway, we use your information to enter your name in the promotion, and, if you are a winner, to fulfill your prize and possibly post certain information about you on our website (e.g., first name, last initial and city of residence only). Any credit card information you provide is used to fulfill and process your online purchases, as well as to provide you a convenient way to store or update payment information for future purchases. This is how we’ve configured these services, and so, if you request them, they will be delivered to you in this manner. In some instances, we may offer you some choices on how these services are delivered, and the extent to which certain information is collected or stored by LeapFrog to provide you these services (see Section 9 for more information about these choices).
In addition to the above, and depending on the information collected and the service for which it is collected, we may also use the information we collect in the following ways:
- To send you mandatory communications such as welcome letters, purchase confirmations, parental notice or consent emails, recall announcements, or other similar transactional or administrative notices;
- To send you informational communications such as newsletters, articles, or personalized learning progress updates;
- If you give your consent to receive them, to send you marketing communications such as product news, event announcements, store discounts, or special offers or promotions from LeapFrog;
- If you give your consent to receive them, to send you mailings of our product catalogue and other requested items;
- If you give your consent to receive them, to send you information about the products and services of other companies that we think might interest you (Note: These specific notices would be sent by LeapFrog on behalf of other reputable companies and would not require us to share your personal information. For notices that may come directly from third party companies and require us to share your information, please see Section 7 below);
- To enable you to give us feedback on our products and services, such as through our parent panel programs, periodic product research studies, and customer satisfaction surveys;
- To provide you a convenient, highly relevant, and personalized experience when you use our Online Services and connected product devices (examples may include greeting you by your name when you revisit and login to our websites, making product recommendations based on online store purchases or a child/student’s unique learning progress, or displaying the total reward points earned by your child/student from game play);
- For identification, eligibility, and security purposes, such as to help verify your identity when you log in to your account, confirm eligibility in a sweepstakes or contest, or help prevent unauthorized access to or use of your account information;
- To advise you, through the use of online advertising devices such as web banners and search advertising inquiries, of LeapFrog products, services, promotions, and special offers which may be of interest to you;
- To conduct internal and external market analysis and research studies; and,
- To otherwise improve and customize our products, services, and technologies to better meet your needs and the needs of your children/students.
Enhancing our consumer records
In order to effectively carry out some of the uses described above, we may combine information collected from one LeapFrog Online Service with information obtained through another LeapFrog Online Service. In addition, we may obtain additional consumer data, or enhance, update, or add to our existing consumer records with personal or demographic information we acquire from third party sources (e.g., data aggregators, third party promotional partners, etc.), and use this information for our own internal purposes, to enhance your use of the Leapfrog Online Service or, if you consent, for marketing purposes.
9- With whom do we share your information?
LeapFrog may share your information, including (in some cases) your personal information and any children/student information under your account, in the following situations:
- When we hire vendors to perform services on our behalf, such as helping us operate a LeapFrog website or Online Service, fulfill a contest or sweepstakes, administer surveys, process online store transactions, execute and optimize marketing/advertising campaigns, and manage and enhance consumer data. These companies are only allowed to obtain the personal information they need to perform the specific task they’ve been hired to do and are prohibited from using the information for any other purpose. They have also agreed to keep your information confidential and secure. In the case of any network advertiser hired by LeapFrog, LeapFrog requires the network advertiser to refrain from sharing or using any data collected at the request of LeapFrog for the benefit of anyone other than LeapFrog unless LeapFrog has your explicit consent for that type of use.
- When we share your information with the family of LeapFrog companies, including our subsidiaries, parent company, or international companies. This allows us to get a better understanding of who our consumers are worldwide, improve our products based on global needs and interests, and market our products using local resources and based on local interests.
- Provided you give your consent, when we partner with independent, carefully-selected third party companies as part of a jointly-sponsored promotion or to offer you the ability to receive special offers and discounts directly from third party companies. For example, we may team up with a third party company to offer a contest, giveaway, or other promotion that promotes both our products and theirs, and as part of such promotion, agree to share the collected consumer data (including personal information such as your name and email address). Similarly, when you register for a LeapFrog account or otherwise sign-up to receive LeapFrog marketing communications, we may allow you to simultaneously sign-up to receive email offers directly from third party companies who offer other products or services that might interest you. A limited amount of personal and demographic information (such as your name, email address, and ages of children in your household) may be shared as part of such third party email program.
We take measures to help ensure that our third party partners agree to protect the confidentiality, integrity, and security of any personal information we share with them. When, with your consent, your personal information is shared or simultaneously collected by a third party company as described above, it will either be obvious to you from the context (such as clearly marked third-party branding on the page) or you will be notified about the sharing at the time your personal information is requested. You will always be given the opportunity to opt-in to such sharing practices before they are initiated and also subsequently to unsubscribe from receiving any further communications should you wish to do so.
Who else has access to your information?
- If we are bought or acquired by another company (either fully or partially), merged with another company, or experience a reorganization, bankruptcy, or other similar event, your information may be shared with our successor or assign (i.e., the new company or the company that takes over).
- If we are required to share your information because such action is reasonably necessary to comply with legal-related processes, enforce contract terms, respond to or resolve any claims (including valid consumer complaints), or otherwise protect or enforce the safety or rights (including intellectual property rights) of LeapFrog, our business customers and partners, our consumers, or the general public.
- If we wish to generally assess (with the help of a third party company) how our Online Services are performing in the Internet marketplace, their popularity or use amongst certain consumer demographics or profiles, and other similar performance metrics, the information disclosed for these purposes will be in aggregate form and limited to demographic or other anonymous data; no personal information will be shared.
10 - How do we protect your personal information?
LeapFrog uses a variety of organizational, technical, and physical safeguards to help protect the security of your personal information (i.e., to prevent it from being lost, destroyed, stolen, misused, or accessed by an unauthorized person). These measures include, but are not limited to:
- Using industry-standard encryption to protect credit card numbers when they are transmitted to LeapFrog through any of our Online Services;
- Storing your personal information in secure operating environments that are only accessible to authorized LeapFrog employees and vendors on a strict need-to-know basis; and,
- Requiring our online users to verify their identities with unique login information before they can access or modify their LeapFrog account information or settings.
11- How you can help protect your information
You can also play a role in helping keep your personal information safe. If you are required to create a unique password to restrict access to your account, choose a password that is hard for others to guess (one that has a combination of letters, symbols, or numbers), and be sure never to reveal it to anyone else. It is your responsibility to keep your password and account information confidential at all times. If you use a shared or public computer, never choose to have your login information remembered and make sure to log out of your account every time you leave the computer. If you are an educator, you should avoid saving or downloading any student progress information onto shared or public computers.
It is your responsibility to keep your LeapFrog account information (including your email address) current and accurate, and to notify us if your email account ever changes or is terminated. LeapFrog assumes no responsibility for misdirected messages (i.e., messages sent to an email account which you no longer own). Misdirected messages could reveal personal information about you (or the children/student profiles under your account) to unintended third parties.
If you own a LeapFrog connected product, the product may be designed to store certain information on the physical device itself (for example, a child’s first name and/or product usage and play data). For your protection, before selling or otherwise transferring ownership of your LeapFrog product, please be sure to clean off and securely remove all information from the device itself, including any play data. One way you could do this is by connecting the product to your computer and doing one last upload or sync to the corresponding LeapFrog software application. In most cases, this will automatically erase the information stored on the product device. For additional help, please contact Customer Service using the information provided at the top of this Policy.
12- How can you access and modify your personal information, opt-out, or change your account preferences and settings?
The best and simplest way to do this is to first login to your account and then go to the relevant account management section of our website or Online Service where you can view and update your account information, unsubscribe from LeapFrog marketing communications (assuming you have already opted in to receiving these), or modify other preferences and settings. These areas are usually marked clearly on our website or Online Service (for example, they may be labeled as “My Account,” “Your Account,” “Edit Profile,” “Settings,” or other similar names), and may offer a variety of options that allow you to update information we’ve stored about you or any children/student profiles under your account, delete accounts or profiles, or otherwise maintain control over how your information is collected, stored, used, or shared by LeapFrog. If these options are not available on our website or Online Service you are using, or you wish to make a request or modification different from what is offered or allowed within these account management areas, the following additional options are available to you:
- Opting out from LeapFrog marketing communications – At the time of registration or data collection, you will be given the option to opt-in to receiving marketing communications from LeapFrog by un-checking a noticeable check box.
With every marketing communication we send you, we provide you a process to opt-out from receiving future marketing messages of the same kind (i.e., unsubscribe). Simply follow the unsubscribe process or directions provided within each such marketing communication. Please note that even if you opt out from all LeapFrog marketing communications, you may continue to receive mandatory communications from us (as noted in Section 6 above).
- Customer Service – For additional help, you can always contact Customer Support using the information provided at the top of this Policy.
13 - How do we handle children’s personal information?
As a leading manufacturer of children’s educational toy products, LeapFrog recognizes the importance of protecting children’s information and strongly encourages parents to be actively involved in their children’s online activities. For this reason, we will not knowingly collect or solicit any personal information directly from children or children-aged students. Please note that we regard children as anyone under the age of 16
- We will only collect children’s personal information from adults. LeapFrog’s online data collection activities are primarily targeted at parents and educators, and thus we do not collect personal information (defined above) from users that we know to be children. If we seek to have personal information about children, we will always request this information directly from a parent, educator, or other adult (but not the child) and on a portion of our website or Online Service intended only for such adults. In addition, any children’s information is stored as part of the corresponding adult’s LeapFrog account (not a child’s account), and can only be accessed by the adult account owner.
- Children’s activities are accessible with no personal information required. Any online activities we make available for children in particular, such as online game play, artwork studios, or reward centers, are only accessible without the need for the child to provide any personal information. As an example, children are allowed to use the online child-friendly activities or play areas with only a username (such as a nickname or character name) or other non-personal login information (as defined above). If any such activities or play areas offer a means for children to chat or otherwise interact with other players online, such features will only be designed so that children cannot reveal or exchange any personal information or any information which identifies the child. For example, children may be limited to using menu-based chat, which requires them to choose from a pre-established list of short phrases or emoticons that are created by LeapFrog and that do not contain any personal information.
We will always ask for verifiable parental consent for any activities, such as a one-time contest, e-card or wish list, where we will require a limited amount of personal information (such as an e-mail address), and this information will only be used to administer the contest or facilitate the one-time communication. It will not be stored or further used by LeapFrog once the specific one-time communication or service has been fulfilled.
When children use our connected product devices, as well as certain child-friendly areas of our websites and web-connected software applications, we may automatically collect and upload certain technical and usage information (as described in Section 4 above - “More about product usage and play data”). This type of information by itself is not personally identifiable, but it may be associated with a parent or educator’s LeapFrog account (which includes personal information) for the purpose of producing the LeapFrog Learning Path and allowing us to provide parents/educators with personalized recommendations for additional LeapFrog products.
- We always obtain parental consent when collecting personal information from children. Depending on the Online Service and the intended use(s) of the child’s information, this process could vary, and may, for example, involve a prior opt-in consent obtained from the parent using such mechanisms as e-mail with follow-up confirmation, a credit card transaction, a printed form with the parent’s signature, or other mechanism permitted by law.
- We handle children’s personal information according to this Policy. Unless noted differently in this Section 10 or elsewhere in this Policy, any personal information collected from children will be used, protected, and disclosed in accordance with the other terms of this Policy (as set forth in detail in Sections 1–9 above). LeapFrog does not share any personal information about children with third party companies unless parental consent has been obtained in advance.
- Parents/educators can access and control their children’s information and activities at any time. Parents have the ability to review the personal information we’ve stored about their child, request that we delete their child’s personal information, or stop the further use or online collection of their child’s personal information. In the school context, educators may be given similar controls with respect to the handling of personal information collected from or about their children-aged students. As mentioned earlier, because all personal information about children or students is initially collected from a parent or educator (not the child or student) and stored as part of the adult’s LeapFrog account profile, the designated account management or edit profile area for that account allows the parent/educator to view and update their children/students’ personal information. For online play areas that contain interactive features such as chat, parents/educators may be given additional controls to manage their children/students’ online activities, including the ability to set play time limits, turn chat features on and off, and control friends’ lists. Prior to taking any of the actions above, the parent/educator may be required to log in to their LeapFrog account and/or verify their identity.
