LIMITED “KID-PROOF” LEAPPAD TABLET HARDWARE WARRANTY EXCLUSIVELY FOR LEAPPAD TABLETS PURCHASED AT LEAPFROG.COM
Effective October 18, 2013
This limited “kid-proof” LeapPad tablet hardware warranty and liability agreement only covers LeapPad tablets purchased directly from Leapfrog.com. It excludes all LeapPad tablets other than those purchased from LeapFrog at leapfrog.com. This warranty does not cover LeapPad tablets purchased from retailers, whether online or in physical stores. LeapFrog Enterprises, Inc. (“LeapFrog”) warrants to the original purchaser that if a LeapPad tablet hardware purchased from LeapFrog.com (the “Product”) ceases to function in accordance with LeapFrog’s most current specifications for the applicable product during a period of one (1) year from the original date of purchase ("Warranty Period"), then LeapFrog will replace the LeapPad tablet hardware as set forth below.
If the Product ceases to function in accordance with LeapFrog’s most current specifications for the applicable product during the Warranty Period, your sole remedy and LeapFrog’s sole and exclusive liability shall be limited to replacement of the Product with a new or refurbished Product at LeapFrog’s option. "Refurbished" means a Product that has been returned to its original specifications.
You are limited to one (1) replacement per Product during the Warranty Period. In the event that LeapFrog replaces your Product under this “Kid-Proof” warranty, the replacement will remain covered by our regular Limited Hardware Warranty and Liability Agreement for the remainder of the Warranty Period or, where the Warranty Period has expired, for thirty (30) days from the date that the Product is returned to you.
All warranty claims are subject to LeapFrog’s: (i) receipt of notice of a defect within the Warranty Period; (ii) verification of the existence of the defect in the Product; and (iii) receipt of valid proof of purchase from leapfrog.com and the purchase date and (iv) if requested by LeapFrog, return of the Product to LeapFrog at purchaser’s expense.
This “Kid-Proof” warranty is void and will not apply if the Product is:
· Modified or tampered with;
· Used for commercial purposes (including rentals, education centers or schools); or
· Lost or stolen.

Before returning a Product to LeapFrog, notify the LeapFrog Consumer Service Department. If the service representative is unable to solve the problem, you will be provided with instructions as to how to have the Product replaced. If LeapFrog believes that there may be a valid warranty claim and confirms the original place and date of purchase for the Product, LeapFrog will provide you instructions for returning the Product.
THIS WARRANTY IS PROVIDED TO YOU IN LIEU OF ALL OTHER EXPRESS OR IMPLIED WARRANTIES INCLUDING WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE FOR THE PRODUCT, WHICH ARE DISCLAIMED HEREUNDER. HOWEVER, IF SUCH WARRANTIES ARE REQUIRED AS A MATTER OF LAW, THEN THEY ARE LIMITED IN DURATION TO THE WARRANTY PERIOD AS PERSCRIBED BY LOCAL LAW.
YOUR SOLE AND EXCLUSIVE RECOURSE IN THE EVENT OF ANY DISSATISFACTION WITH OR DAMAGE ARISING FROM THE USE OF THE PRODUCT AND LEAPFROG’S MAXIMUM LIABILITY SHALL BE LIMITED TO REPAIR OR REPLACEMENT OF THE PRODUCT. IN NO EVENT WILL LEAPFROG BE LIABILE FOR ANY LOSS OF DATA, LOSS OF PROFIT OR ANY OTHER LOSS OR DAMAGE SUFFERED BY YOU OR ANY THIRD PARTY, WHETHER SUCH DAMAGES ARE DIRECT, INDIRECT, CONSEQUENTIAL, SPECIAL OR INCIDENTAL AND ARISING UNDER ANY THEORY OF LAW FOR YOUR USE OF THE HARDWARE. Some states do not allow limitation on how long an implied warranty lasts and some states or provinces do not allow the exclusion or limitations of consequential or incidental damages, so the limitations or exclusions may not apply to you.
This warranty gives you specific legal rights, and you may also have other rights which vary from state to state. This warranty is valid only in the United States. The warranty offered by LeapFrog is the same whether or not you register your product.
This warranty only applies to LeapPad tablet hardware units and, without limitation, does not apply to the following LeapFrog products: software cartridges, software downloads, cases, accessories, value cards, online services (including, without limitation, the LeapFrog Learning Path and leapfrog.com website), packaging or any other products or services provided by LeapFrog, even if bundled with a LeapPad tablet at the time of purchase.
90 DAY, HASSLE-FREE RETURNS
Items purchased from the LeapFrog Online Store can be returned for refund within 90 days of the date of purchase, as long as the product has not been used and is in its original packaging.
When returning merchandise, please repack the item(s) you are returning in the original shipping box or a similar box. Then circle the item(s) being returned on the enclosed packing slip and send this along with the return. Please keep a copy of the packing slip for your records. A print-out of your order confirmation email may be substituted for the packing slip.
Items sold as part of a bundle package may not be returned separately; bundle contents must be received in full for a refund to be processed. Occasionally we offer special promotions such as “buy 2, get 1 free.” If you would like to return merchandise purchased as part of a promotion, you must also return the free item in order to receive a full refund. Any item that is returned without the promotional item(s) that was included with the original transaction will have the value of the promotional item deducted from the refund amount.
If you do not include the packing slip or order confirmation email with your return, or if we receive the merchandise after the 90-day return period, a credit will not be issued and your merchandise will be returned to you.
Refunds for merchandise will be issued to the original form of payment at the billing name and address on the original order.
Shipping charges are not refundable.
We recommend returns be shipped via a method which provides proof of delivery such as UPS, FedEx, or registered mail. Make note of your tracking number for your files. LeapFrog is not responsible for items lost during shipping.
We do not accept COD returns.
