DESCRIPTION: The “Brainpower Breakfast” Sweepstakes (“Sweepstakes”) begins November 15, 2007 at 12:01 a.m. [PT] and ends on June 30, 2008 at 11:59 p.m. [PT] (“Sweepstakes Period”). The Sponsor of this Sweepstakes is LeapFrog Enterprises, Inc. (“Sponsor”). The administrator of this Sweepstakes is Visionworks Promotion, Event & Creative Development Company (“Sweepstakes Administrator”).
HOW TO ENTER: To enter, visit the Sweepstakes web site during the Sweepstakes Period by logging on to http://www.LeapFrog.com/quaker. Follow the on-screen instructions to submit one entry into the Sweepstakes. All entries must be received by 11:59 p.m., [PT], on June 30, 2008. Limited to one entry, per person, within a 24-hour period. Entries generated by a script, macro or other automated means will be disqualified. Each entrant must be the rightful owner (or have authorized use) of the e-mail address identified in the entrant's entry as of November 15, 2007. In the event of a dispute as to the identity of a winner, the winner will be deemed to be the person in whose name the e-mail account governing the e-mail address was opened. Entrants must provide all information requested to be eligible to win. Incomplete, unreadable, or unintelligible entries will be disqualified. All information provided by entrants becomes the property of Sponsor.
ELIGIBILITY: Sweepstakes is open to legal residents of the 50 United States and Washington, D.C. who are at least 21 years of age. Any individuals (including but not limited to employees, consultants, independent contractors and interns) who have, within the past six months, held employment with or performed services for Sponsor, Sweepstakes Administrator or any organizations affiliated with the sponsorship, fulfillment, administration, prize support, advertisement or promotion of the Sweepstakes, and/or their respective parent, subsidiary, affiliate and successor companies, and immediate family and household members of such individuals are not eligible to enter or win. “Immediate Family Members” shall mean parents, step-parents, legal guardians, children, step-children, siblings, step-siblings, or spouses. “Household Members” shall mean those people who share the same residence at least three months a year.

Grand Prize Packages (10)Ten (10) Grand Prize winners will receive the Ultimate Field Trip for four (4). Each Grand Prize Package will consist of: one (1) 3 day/2 night trip for four (4) people including; (a) round-trip coach class air transportation for four (4) people to Washington, D.C. from the major gateway airport nearest the winner’s residence, (ARV: $2,000.00); (b) two (2) nights hotel accommodations for four (4) guests at a hotel selected by Sponsor [quad occupancy], (ARV: $300.00); (c) four (4) single day admissions valued at $50.00 cash per person for use at an attraction of winner’s choice, (ARV: $200.00); (d) $50.00 cash for ground transportation, (ARV: $50.00); (e) $720.00 cash for meals. Meal per diem averaged at $20.00 per person for four (4) people times nine (9) meals per person, (ARV: $720.00); (f) four (4) Leapster software titles, (ARV: $100.00); (g) one (1) Leapster Portable Learning Systems, (ARV: $60.00; (h) one (1) Leapster Portable Learning Systems Carrying Case, (ARV: $18.00); [Grand Prize ARV: $3,448.00] Total Promotional Value: $34,448.00 Final value of the Grand Prize depends on winner’s place of residence and cost and availability of airfare and hotel at time of booking and travel may be substantially higher or lower than estimated value. If a winner lives within 250 miles of Washington, DC airfare will be forfeited and no additional compensation will be provided, however, the ARV of the prize will be adjusted accordingly. Trip dates will be specified by the Sponsor and travel must occur by December 15, 2008. Airline is determined by Sponsor and may require a Saturday night stay. Sponsor’s choice of airlines may necessitate connecting flights. Airline Ticket booking is subject to availability. No code-share flights, one-way trips or upgrades allowed. Black out dates do apply and include but are not limited to August 29, 2008 through September 2, 2008 and November 23, 2008 through November 30, 2008. Airline Tickets may be booked only through a designated booking contact via the official Booking Request Form. Airline Tickets must be booked via Orbitz with a minimum of twenty-one (21) days’ advance notice and must comply with all Booking Guidelines. Once Airline Tickets have been issued, they are non-refundable in cash and shall not be re-bartered, sold, endorsed, exchanged, transferred or in any other manner modified by the individuals to whom such Airline Tickets are issued or by anyone on behalf of the individuals to whom issued. Once Airline Tickets are issued, itineraries cannot be changed. Individual passengers shall be responsible for all payments of excess baggage charges, upgrades, taxes and any other charges incurred after or in connection with the issuance of Airline Tickets. Once the prize is issued, any subsequent costs for changes, cancellations or alterations are the sole responsibility of the winner. Sponsor reserves the right to change travel dates and to substitute any or all of these portions of the prize for a prize comparable or greater value should they become unavailable or impractical for any reason. Grand Prize winner is solely responsible for all expenses not specifically set forth herein, including but not limited to additional meals and hotel charges (other than room and room tax), gratuities, tips, taxes and incidentals. Individual passengers shall be responsible for all payments of excess baggage charges, upgrades, taxes and any other charges incurred after or in connection with the issuance of Airline Tickets. Winner will be responsible for any and all federal, state and/or local taxes resulting from acceptance of the prize. Prize winners cannot assign or transfer the prize to another person. No cash or prize substitution is allowed except at the discretion of Sponsor. All prizes will be awarded. If a prize cannot be awarded due to circumstances beyond the control of Sponsor, a substitute prize of equal or greater retail value will be awarded; provided, however, that if prizes are awarded but unclaimed/forfeited by recipient, prize may not be re-awarded, in Sponsor's sole discretion. Other restrictions may apply. Odds of winning depend on the number of eligible entries received. Limit one prize per person, per household.
WINNER SELECTION AND NOTIFICATION: Winners will be selected in a random drawing conducted by the Sweepstakes Administrator from all eligible and correct entries on or about July 15, 2008. Prize winners will be notified by telephone and/or overnight mail on or about July 30, 2008. Prize winners will be required to verify address and to execute before a notary public and return within seven (7) days an affidavit of eligibility and liability/publicity release covering eligibility, liability, advertising, publicity and media appearance issues, unless prohibited by law. Failure to return the executed affidavit and release forms within the specified time period may result in forfeiture of the prize and selection of an alternate winner from the remaining eligible entries. Prize will not be awarded until all such properly executed and notarized forms are returned. Prizes will be delivered within 30 days of receipt of properly executed forms.
CONDITIONS OF PARTICIPATION/RELEASES: Sweepstakes is void where prohibited or restricted by law. All federal, state and local laws and regulations apply. By participating, entrants agree to be bound by these official rules and the decisions of the Sponsor and the Sweepstakes Administrator, which shall be final in all respects. By participating in this Sweepstakes and/or by accepting any prize that they may win, entrants agree to release the Sponsor and Sweepstakes Administrator; The Quaker Oats Company, their respective parent, subsidiary and affiliated companies, units and divisions and advertising and promotional agencies and prize suppliers; each of their respective officers, directors, agents, representatives and employees; and each of these companies and individuals' respective successors, representatives and assigns (collectively, the "Released Parties") from any and all actions, claims, injury, loss or damage arising in any manner, directly or indirectly, from participation in this Sweepstakes and/or acceptance or use of the prize. Entrants authorize the Released Parties to use their name, voice, likeness, biographical data, city and state of residence and entry materials in programming or promotional material, worldwide in perpetuity, or on a winner's list, if applicable, without further compensation unless prohibited by law. Sponsor is not obligated to use any of the above mentioned information or materials, but may do so and may edit such information or materials, at Sponsor's sole discretion, without further obligation or compensation. The Released Parties shall not be liable for: (i) late, lost, delayed, stolen, misdirected, postage-due, incomplete unreadable, inaccurate, garbled or unintelligible entries, communications or affidavits, regardless of the method of transmission; (ii) telephone system, telephone or computer hardware, software or other technical or computer malfunctions, lost connections, disconnections, delays or transmission errors; (iii) data corruption, theft, destruction, unauthorized access to or alteration of entry or other materials; (iv) any injuries, losses or damages of any kind caused by the prize or resulting from acceptance, possession or use of a prize, or from participation in the Sweepstakes; or (v) any printing, typographical, administrative or technological errors in any materials associated with the Sweepstakes. Sponsor disclaims any liability for damage to any computer system resulting from participating in, or accessing or downloading information in connection with this Sweepstakes, and reserve the right, in their sole discretion, to cancel, modify or suspend the Sweepstakes should a virus, bug, computer problem, unauthorized intervention or other causes beyond Sponsor's control, corrupt the administration, security or proper play of the Sweepstakes. Sponsor may prohibit you from participating in the Sweepstakes or winning a prize if, in their sole discretion, they determine you are attempting to undermine the legitimate operation of the Sweepstakes by cheating, hacking, deception, or any other unfair playing practices of intending to annoy, abuse, threaten or harass any other players or Sponsor representatives. This Sweepstakes will be governed by the internal laws of the State of California. Any and all legal actions or claims arising in connection with this Sweepstakes must be brought in a court of competent jurisdiction within the United States. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE THE WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND WILL RESULT IN DISQUALIFICATION FROM PARTICIPATION IN THE SWEEPSTAKES. SHOULD SUCH AN ATTEMPT BE MADE, SPONSORS RESERVE THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEY FEES) TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.
