These are the Official Rules for the LeapFrog 2012 Spooktacular Halloween Contest (the “Contest”). The sponsor and administrator of this Contest is LeapFrog Enterprises, Inc., 6401 Hollis Street, Emeryville, CA 94608, U.S.A. (“Sponsor”).
The Contest is open only to legal residents of the fifty (50) United States (including District of Columbia) (the “Territory”) who are at least eighteen (18) years old at the time of entry. Employees of Sponsor, its parent, subsidiaries, affiliates or agencies and suppliers (individually “Entity” and collectively, “Entities”) and the immediate family (i.e. spouse, parents, siblings and children) and household members of each Entity are not eligible. All applicable federal, state, and local laws and regulations apply. Void where prohibited. Participation constitutes entrant’s full and unconditional agreement to these Official Rules and Sponsor's decisions, which are final and binding in all matters related to the Contest.
The Contest begins on October 1, 2012 at approximately 8:00:00 a.m. Pacific Standard Time (“PST”) and ends on November 2, 2012 at 11:59 p.m. PST (the “Contest Period”). Sponsor’s computer is the official time-keeping device for the Contest. The Contest consists of five (5) weekly entry periods (each a “Weekly Entry Period”) as follows:

4. How to Enter
To enter the Contest you must be a registered member of Facebook. If you are not a registered member of Facebook, please visit http://www.facebook.com to register for an account. Registration for and use of Facebook and other Facebook applications are subject to Facebook's terms and conditions and Sponsor has no responsibility with respect to Facebook registration and use. This Contest is in no way sponsored, endorsed or administered by, or associated with Facebook.
How parents can enter the Contest:
Entrants may enter any number of unique Photo entries per week for each of the five (5) Weekly Entry Periods in the Contest. Any attempt by an entrant to submit non-unique entries on a multiple basis or any other attempts by an entrant to submit excessive entries or entries that do not meet the photo guidelines set forth herein may result in disqualification at the sole discretion of the Sponsor. Use of any automated system to participate is prohibited and will result in disqualification.

6. Winner Selection and Notification
Sponsor will select the winner for each of the Weekly Entry Periods based on who uploaded the best Photo and caption (as determined by Sponsor in its sole discretion) for that Weekly Entry Period. Winners will be selected within one (1) week after the close of the Weekly Entry Period. Sponsor will notify winners via a Facebook comment posted underneath the Photo with instructions for the entrant to email Sponsor at email@example.com with entrant’s name, email address and physical address. It is the entrant’s obligation to keep an active Facebook account with settings that will allow entrant to receive the comments Sponsor posts under entrant’s Photo. It is the entrant’s obligation to notify Sponsor in writing of any change of contact information. Each potential winner will be required to respond to the winner notification comment within 72 hours from the time Sponsor posts the winner notification comment in order to claim the Prize. If the potential winner cannot be contacted or fails to respond within the required time period or fails to comply with any other term of these Official Rules, that potential winner forfeits the Prize. Wining is contingent upon fulfilling all requirements of these Official Rules. In the event that a potential winner is disqualified for any reason, Sponsor will award the applicable prize to the next best entry from among all remaining entries from the applicable Entry Period. Only one (1) alternate winner will be selected for an Entry Period, after which the Prize will remain un-awarded. Prizes will be fulfilled within two (2) weeks after winner confirmation.
There are a total of five (5) Weekly Entry Periods during the Contest Period. There will be one winner selected for each Weekly Entry Period (a total of five (5) winners during the Contest). One Prize will be awarded to the winner of each Weekly Entry Period. The Prize consists of a LeapPad2 learning tablet. The total approximate retail value (“ARV”) of the Prize is $99.99. The Prize is non-transferable, and no substitution or cash redemption or equivalent will be permitted except at the Sponsor’s sole discretion. Sponsor reserves the right to substitute a prize for one of equal or greater value if the designated prize should become unavailable for any reason. Prizes will be mailed to winners within approximately two (2) weeks of the end of the Contest Period. Winners are responsible for all taxes and fees associated with Prize receipt and/or use.
The Photo, caption, comments, and other feedback entrant submits in connection with this Contest shall collectively be referred to as “Feedback”. Entrant attests that the Feedback entrant submits reflects entrant’s true and accurate beliefs and opinions and has been created solely by entrant. Entrant grants permission to Sponsor to use the Feedback for any commercial purpose (including, but not limited to advertising, marketing and promotional purposes) on a worldwide basis, in perpetuity, in any and all media and manner (whether now known or later developed). The Feedback contains entrant’s and/or entrant’s child’s/children’s full name, city, state, image (whether in photograph or video), likeness, voice, quotes, or other personal information (“Personal Information”). Entrant agrees that Sponsor may use entrant’s and entrant’s child’s/children’s Personal Information contained in the Feedback in advertising, marketing, and promotion of the Sponsor’s brands and products on a worldwide basis, in perpetuity, and in any and all media now known or hereafter devised. Entrant agrees that neither entrant nor entrant’s child/children will be provided with any further payment, notification, permission, or other consideration, or any approval right prior to Sponsor’s use of such Feedback. Entrant acknowledges that Sponsor has the right to edit the Feedback for length, clarity, grammar, and product name accuracy.
Entrant and entrant on behalf of entrant’s child/children featured in the Feedback hereby forever releases, holds harmless and discharges Sponsor, its subsidiaries, advertising/promotion agencies, and each of their directors, officers, employees, agents and representatives, from any claim or demand, whether known or unknown, suspected or unsuspected, disclosed or undisclosed, that directly or indirectly arises out of or relates in any manner to use of entrant’s or entrant’s child’s Personal Information, including, without limitation, any claims for defamation, invasion of privacy, and/or infringement of intellectual property rights. Entrant also hereby releases and holds harmless Sponsor and its subsidiaries, advertising/promotion agencies, and each of their respective parent companies and each of their officers, directors, employees and agents from and against any claim or demand, whether now known or unknown, suspected or unsuspected, disclosed or undisclosed that directly or indirectly arises out of or relates to entrant’s participation in the Contest, including, but not limited to, personal injury, death or damage to or loss of property.
10. Limitations of Liability
Sponsor is not responsible for: (1) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Contest; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Contest; (4) technical or human error which may occur in the offer or administration of the Contest, including but not limited to errors in the advertising, Official Rules, selection and announcement of the winners and distribution of the prizes or the processing of entries; (5) any inability of any winner to accept or use any prize for any reason; or (6) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Contest or receipt or use or misuse of any prize.
Except where prohibited, entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Contest or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for the Northern District of California, U.S.A. or the appropriate California State Court located in Alameda County, California U.S.A.; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Contest, but in no event attorneys’ fees; and (3) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the laws of the State of California U.S.A., without giving effect to any choice of law or conflict of law rules (whether of the State of California or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of California, U.S.A.

Winners will be announced during the week following each Weekly Entry Period on the LeapFrog Spooktacular Halloween event Facebook tab and may be announced on the LeapFrog Halloween website page on leapfrog.com.
